Department Profile Professionals within Legal and Compliance provide a wide range of services to our business units. They might help to structure a complex and sensitive cross-border transaction; advise on a new product introduction; develop a training program or defuse an investor dispute. They preserve the firm’s invaluable reputation for integrity and protect the firm from sanctions with policies and procedures that meet regulatory requirements around the world. They also strive to maintain cooperative relationships with governmental policy makers and the regulatory and self-regulatory agencies that govern the firm’s businesses.
Background on the Position Morgan Stanley is seeking an attorney with significant experience in North American privacy, information security and marketing laws and regulations, including the Gramm-Leach-Bliley Financial Services Modernization Act of 1999, the Fair Credit Reporting Act, the California Consumer Privacy Act, the New York State Department of Financial Services cybersecurity regulations, state privacy laws, PIPEDA, CAN-SPAM, CASL, and TCPA. The ideal candidate should be familiar with U.S. Federal regulation of the financial services industry, including its principal regulators and their jurisdiction over privacy and information security matters.
Primary Responsibilities -Serve as the principal legal advisor for privacy matters to all Morgan Stanley entities and business units in North America. -Advise on requirements and restrictions on the collection, storage and sharing of sensitive client and employee information.
-Assist in the development of a comprehensive privacy law program, coordinating North American and International privacy and information security legal requirements.
-Advise on restrictions on surveillance, monitoring of electronic communications and the use of tracking or profiling.
-Serve as a critical team member in responding to information security incidents involving personal information.
-Develop and maintain notices, policies and procedures for privacy and information security, consistent with applicable international, federal and state laws, rules and guidance.
-Maintain current knowledge of applicable state, federal and international privacy laws and regulations.
Skills required (essential) -J.D. with a minimum of 5 years’ experience, including experience in or with financial services firms -Admitted to practice in a U.S. state -International Association of Privacy Professionals (IAPP) Certification desired, but not required -Ability to manage multiple tasks concurrently in an efficient and effective manner -Strong organizational, project management and reporting skills -Polished written and verbal communication skills -Strong interpersonal skills and ability to work in a group or independent setting
-Ability to interact and effectively advise senior members of the Firm and its business units.
-Technical background and knowledge of information security principles preferred.
