Long International and Lower Churchill Management Corporation have an immediate need to assign a full time consultant to work on the owner’s team of a hydroelectric power plant project as a Disputes Resolution Manager.
We are looking for a seasoned, dependable, and committed individual with the intent to stay on for the duration of the project.
The Disputes Resolution Manager will work at the project office in St. John’s, Newfoundland and Labrador, Canada, for a large hydroelectric generating facility that will produce clean, renewable energy to meet the growing energy demands in the Province. .
This position will be classified as a 1099 Independent Consultant with a project office compensation rate of US$2,002.50 per day.
Terms: The term of this position is expected to last for two years. Contractual position. Day Office rate is based on a cap of 10 hours per day, including casual overtime. Rotation is 5 days at office, 2 days off, will work weekends to support the business work requirements.

Benefits: Living Out Allowance of CAD$4,000.00 per month and a Travel Allowance of CAD$1,300.00 per month; Mobilization and Demobilization Allowance of CAD$1,000.00
The successful candidate will have broad dispute resolution, claims analysis, and claims avoidance expertise preferably with power plant projects. This position will be responsible for, but not limited to, performing the following tasks:
Lead the analyses and resolution of contractor claims and requests for equitable adjustment.
Assist in negotiations of contractor claims and requests for equitable adjustment.
Interact extensively with other members of the Project Management Team, Project Controls, Engineering, Contracts Management, Area Construction Managers, and the function managers for Supply Chain and Accounting.
Perform other related duties as assigned.
Experience with construction claims identification, analysis, written responses, and real-time mitigation during construction
Advanced knowledge of plan reading and construction contract clause interpretation.
Advanced knowledge of critical path method scheduling, including familiarity with contract scheduling specifications.
Advanced knowledge of entitlement and quantum calculation methodology.
Advanced knowledge of CPM schedule delay analysis techniques.
Review and analyze schedules with Primavera P6 (scheduling software).
Utilization of the Aconex system.
Provide direction and support to the Project Delivery Team in disputes avoidance and mitigation Review contracts to understand how the contracts allocate risks.
Instill behaviors that emphasize a vigilant watch for troubles and a propensity for responsive action, communication, and a commitment to resolve problems proactively and in a timely manner.
Develop a plan for managing these risks.
Develop and maintain a project controls system, which should be designed to track risks and project metrics in a way that is meaningful to all parties that will provide an early warning system to alert the parties of areas that require attention in order to avoid or mitigate added costs and delays due to: disruptions, differing site conditions, extra work, acceleration, and any event involving an increase in contract time and cost.
Recognize the events that lead to claim issues.
Track status of issues toward resolution.
Keep focus on potential claim issues until resolved.
Identify new potential dispute issues.
Determine action tasks required to resolve issues; identify what must be done.
Determine responsibility for taking action and obtain commitment as to time frame for action, and document it.
Work Experience Requirements:
Experience that demonstrates exceptional knowledge of dispute resolution, claims analysis, and claims avoidance techniques and principles.
Demonstrated construction claims/risk management consulting experience using project/contract management systems for project resource estimation and planning, scheduling, cost control and budget management, resource allocation, collaboration software, communication, decision-making, contract administration and project reporting.
Experience with a variety of contracts including power plant projects and service contracts (services supporting the construction effort).
Experience with plant piping, electrical, transmission systems, major civil works, and large earthwork contracts and projects.
Extensive experience in cumulative impact claims, loss of productivity, and acceleration.
Familiarity with various project management software such as PM Plus PRISM, Prolog, Aconex, Primavera (P6), and Acumen Fuse.Demonstrated leadership skills in developing and leading diverse work teams.
Commercially astute individual with a strong background in contracts management and claims avoidance.
Relevant experience managing a large construction or fabrication site, in particular leading large site teams on other mega-projects.
Requires excellent oral and written skills for communication with a wide variety of internal and external parties.
Testifying experience as an expert witness.
Experience as an arbitrator is desired.
Experience working in northern, cold climates is considered an asset.
Preferred language fluency: English
A bachelor’s degree in architecture, engineering, business administration, construction management, arbitration, or closely related field plus 15 or more years directly related experience in construction disputes analysis including damage analyses and forensic scheduling analyses.
Program Management training (AACE and/or Project Management Institute membership desirable).
